Introduction
The Data Protection Act 1998 says that those who record and use personal information must comply with eight enforceable principles of good practice.
These state that data must be:
- Processed fairly and lawfully
- Processed for limited purposes
- Adequate, relevant and not excessive
- Accurate and up-to-date
- Not kept longer than necessary
- Processed in accordance with the data subject’s rights
- Secure
- Not transferred to countries outside EEA without adequate protection
Requests for personal information for visa or work permit applications to USA, Canada, Australia, New Zealand or South Africa
Individuals requiring ‘police certificates’ for these countries should download an application form from the ACPO Criminal Records Office (ACRO) website. Please note that this certificate is administered entirely by ACRO and all enquiries should be directed to them – 0845 601 3999.
Individuals requiring certificates for the purpose of obtaining a visa to any other country should make a Subject Access Request from Hertfordshire Constabulary (see below).
Requests for personal information for employment purposes
Individuals who require a disclosure for employment purposes should contact Disclosure Scotland on 0870 609 6006.
If a company asks a potential employee to obtain details of their conviction history, this is known as ‘Enforced Subject Access and will become a criminal offence when Section 56 of the Data Protection Act 1998 is implemented; it may also be considered a breach of the Human Rights Act 1998.
Certain types of disclosure made by Disclosure Scotland only contain records considered ‘unspent’ under the terms of the Rehabilitation of Offenders Act 1974 (ROA). For further information about the ROA please contact the National Association for the Care and Resettlement of Offenders on 0207 582 6500.
If you are going to work as a volunteer or a paid employee for an organisation where you will be working unsupervised with children or vulnerable adults and have been asked to apply for 'CRB check', you should contact the Criminal Records Bureau (CRB) on 0870 909 0811.
Subject Access
Section 7 of the Data Protection Act gives an individual the request a copy of any personal data which may be held about them.
Should you wish to know what information (if any) Hertfordshire Constabulary holds about you, and you do not need this information for one of the purposes explained above, please complete a Subject Access form.
